Section 42 of the Road Traffic Offenders Act 1988 provides that you may apply to the courts to have the period of disqualification removed from your driving licence subject to the these time constraints:
- After two years if the disqualification imposed is less than four years.
- After half the period of disqualification period if it is less than 10 years but longer than four years.
- After five years if the disqualification period is longer than 10 years.
It is important to note that being able to make an application to the courts as a result of serving the requisite minimum period of your disqualification does not guarantee that your application will be successful – far from it. Your case will need to be investigated, meticulously prepared and presented to the court for a decision.
The courts will only normally entertain an application of this nature if there is very good reason for removing the period of disqualification early e.g. the opportunity of a new job, the prospect of losing employment or some other material change in circumstances.
For an application to be successful it is normally also a prerequisite that you have been of good behaviour and have not been convicted of any criminal offence since the disqualification was imposed.
Although the courts may consider another application after three months if the original application is refused, in reality you will only get one opportunity to get your driving licence back early.
